ATM theft accused claim insomnia, seek bail release

Two Chinese nationals who allegedly stole about $17,000 tala from ATM machines in Apia have entered a verbal application for bail.

The two accused appeared before Chief Justice Patu Tiavaasu’e Falefatu Sapolu this morning.

Defense lawyer Alex Su’a sought bail for his clients claiming they are not in a safe state.

“Your honour my clients wonder if an application for bail at this time is suitable. They have been experiencing cases of insomnia. They are not eating the food being served at the compound at the moment and they haven’t had any contact with their families since their arrest,” Su’a said.

Prosecution opposed the bail application saying the accused must remain in custody because they are at a high risk of leaving the country.

Su’a responded that Police have seized both men’s travel documents and credit cards so there is no risk of leaving.

Justice Patu stopped the debate midway and issued a court order for both parties to present a written application underlining their arguments.

“By Monday next week, I should have both written applications included within the grounds in which you make your arguments. It is also on that same Monday the 3rd of October that we will call this case in the Supreme Court again,” said Patu.

“In the meantime, the accused will remain in custody,” he added.
