Samoa commissioner can't recall instructions to reopen investigation

A commission is investigating alleged evidence tampering by an assistant police commissioner and a superintendent.

The evidence related to traffic charges against Ms Chang who was then the director of the National Prosecution Office.

The inquiry chairman, former Supreme Court judge Lesatele Rapi Va'ai, questioned Fuiavailili about the handling of the case against Ms Chang.

When asked by Lesatele if he had instructed the now suspended assistant police commissioner Samoa Mulinu'u to reinvestigate Ms Chang's case, Fuiavaili said he could not remember.

Samoa court to set sentencing date for former Director

Justice Mata Keli Tuatagaloa upheld an appeal on the charge of negligent driving causing injury and convicted Mauga of the charge on Friday.

His ruling overturns a decision by the District Court in December last year to acquit Mauga of the charge.

Justice Tuatagaloa also dismissed an appeal on a charge of failure to stop and ascertain.

The appeal was filed by Satiu Simativa Perese, an independent prosecutor, hired by the Attorney General’s Office.

The charges against Mauga stemmed from a three-vehicle accident on Beach Road in Apia, last year.

Samoa prosecutor not guilty on traffic charges

RNZ reports Mauga was charged with negligent driving causing injuries, dangerous driving and failing to stop to check if anyone involved in the accident had been injured.

The New Zealand based prosecutor Satiu Simativa Perese was hired by the government to prosecute the case and says it is too early to say if he will appeal.

"I will look at the judge's reasoning to see what has been decided and then we will make another call, decision after that. But we have rules to obey and it is improper for me to say anything at this point."
